WorkSafeNB is committed to exceptional client service. There may be times you disagree with a decision on your claim and an objective review of the decision can be helpful. The Decision Review Office (DRO) is here to review WorkSafeNB decisions*if you disagree with the original decision. Reporting to WorkSafeNB’s General Counsel, the DRO operates independently of WorkSafeNB’s case management, adjudication and benefit payment services. We are committed to reviewing your decision to determine that it was made consistent with legislation, policy and the merits of the case.
* The DRO does not review decisions made under the Occupational Health and Safety Act.
Advocates Services can help you file a review with WorkSafeNB's Decision Review Office or an appeal with the Worker's Compensation Appeals Tribunal (WCAT). The Advocates Services office helps workers and employers with matters relating to workers’ compensation. Their services are free.
Once a review is requested, new information cannot be presented to the Decision Review Office. If you wish to share new information, send it directly to the person assigned to your claim. Their contact information is on the original decision letter. WorkSafeNB will determine if the new information is relevant to the decision.
Yes, the Decision Review Office will inform you in writing if your decision review application can proceed.
As per New Brunswick legislation:
The Decision Review Office doesn't contact the worker, employer or their representative by telephone during the review process. The process consists of a review of the information in the file. You will receive a written communication from the DRO when your review is complete.
